OLIVER BUILT FOR YOUR ADVENTURE PROMOTION

- Information on how to enter this Oliver footwear promotion (Promotion) and prize details form part of these terms and conditions (Conditions).
- The Promoter is O & S Holdings (Vic) Pty Ltd trading as Oliver Footwear of 1B, 69 Dalton Road Thomastown Victoria 3074 Australia, ABN 720045040187 Telephone: 1300 126 687 (Promoter). The Promotion is being conducted by SAM (Sales and Marketing Agency) of 272 Bay St, Port Melbourne Victoria 3207 Australia. Telephone: 03 9646 5644 (Agency).
- The Promotion is a game of chance. Skill plays no part in this Promotion.
- By participating, entrants agree to be bound by these conditions.
- Entries must comply with these Conditions to be valid.
- Entry is open to Australian and New Zealand residents who are aged 18 years and over during the Promotion Period.
- Directors, officers, employees, agents and contractors of the Promoter and other agencies or companies associated with the Promotion (including employees of retailers participating in the Promotion) and their immediate families, are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
- The Promotion commences at 7.00am AEST on Tuesday 01/04/2025 and closes at 11.59pm AEST on Wednesday 30/04/2025 (Promotion Period).
- To enter: purchase any pair of shoes with a minimum value of $100 from the Oliver footwear range from a participating retailer during the Promotion Period (Eligible Product); and upload a photo of your store receipt by scanning the QR Code at point of sale or clicking the url (https://www.oliver.com.au/buitforthis) as advertised via social media or online at https://www.oliver.com.au/win/promotion; and complete the entry form (including full name, email address, physical address, contact number and corresponding invoice number).
10. Each entrant is limited to one entry into the Promotion per purchase.
- Incomplete, indecipherable, or illegible entries or entries that do not comply with these Conditions will be deemed invalid. For example, entries which do not include the entrant's name, daytime contact number or email address will not be accepted.
- The purchase receipt must clearly show that an Eligible Product was purchased during the Promotion Period. Winners must retain their receipt/s and will be required to provide them to the Promoter to be eligible to claim their prize.
13. Prize draws will take place at SAM (Sales and Marketing Agency 272 Bay St, Port Melbourne Victoria, Australia 3207 · 03 9646 5644) on Monday 12 May 2025 at 11:00 am.
- The winners will be notified by phone and email within two (2) days of the draw and their names (surname, first initial and postcode) will be published on the promotional website www.oliver.com.au from the 19 May 2025 at 11:00am for 28 days. If any winner is located in the Northern Territory their name will be published with a local or national newspaper.
- In Australia five (5) valid entries as determined by random draw will each win a AUD5,000 package of camping and outdoor equipment. The total prize value in Australia is AUD25,000.
- In New Zealand one (1) valid entry will be determined by random draw and will win one (1) NZD5,000 NZD package of camping and outdoor equipment.
- In Australia there will be: 1x draw for all entrants located in Queensland; 1x draw for all entrants located in New South Wales and Australian Capital Territory; 1x draw for all entrants located in Victoria and Tasmania; 1x draw for all entrants located in South Australia/Northern Territory; and 1x draw for all entrants located in Western Australia.
- Subject to the Promoter being able to contact the prize winners, all prizes will be available for collection from a nominated collection point to winners within 28 days of the draw, subject to any processing or delivery delays. Winners will be notified of any delay.
- The Promoters shall not be liable for any loss, damage or injury suffered by any winner as a result of the winner accepting and/or using a prize, except for any loss, damage or injury which is due to the negligence or willful misconduct of the Promoter, or which otherwise cannot be excluded by law.
- Prizes are not transferable or exchangeable and cannot be taken as cash. If any part of the prize becomes unavailable for any reason the Promoter may substitute it for a similar prize of equal or greater value.
- The Promoter reserves the right to request verification of age, identity, residential address and any other information from entrants relevant to entry into or participation in this promotion. Verification is at the discretion of the Promoter; whose decision is final. The Promoter reserves the right to disqualify any individual who provides false information, fails to provide information, conspires with others to gain an unfair advantage or is otherwise involved in any conduct that involves manipulating, interfering or tampering with this promotion or otherwise preventing the conduct of the promotion as intended by the Promoter. In the event of such problems or conduct, then the Promoter may (where necessary with approval from the relevant lottery authority) modify, cancel, terminate or suspend the Promotion.
- The Promoter is not responsible for any incorrect or inaccurate information or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
- The Promoter accepts no responsibility for any misdirected or lost entries or entries not received by the closing date in clause 8.
- The Promoter will take all reasonable steps to contact the winners. In the event of any prize not being claimed by a winner after three months of the draw, this will be published on the promotional website (www.oliver.com) and a second chance draw will be held on 28/07/2025 subject to State Regulations at the same time and place as the first draw to distribute any unclaimed prizes. If required, second chance draw winners will be notified by email within two (2) days of the second chance draw and their names (Surname, first initial and postcode) will be published on the promotional website (www.oliver.com) on 28/07/2025.
- The Promoter collects entrants' personal information in order to conduct the Promotion and for promotional, marketing, publicity, research and profiling purposes. Entry is conditional on providing this information. All entries become the property of the Promoter and may be entered into their databases unless stated otherwise by entrants. Details from entries may be disclosed to State and Territory regulators and the winner’s name and suburb published as required under the relevant trade promotion legislation. A request to access, update or correct any information or obtain a copy of the Promoter's privacy policy should be directed to the Promoters at their addresses set out in these Conditions.
- The Promoter is not responsible for any incorrect or inaccurate information or for any of the equipment or programming associated with or utilised in this Promotion, or for any technical error, or any combination thereof that may occur in the course of the administration of this Promotion including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries. All entrants warrant that they have all necessary rights and ownership of any material submitted as part of their entry into this Promotion and that such material is not capable of infringing the intellectual property rights of a third party.
- The Promoter will not return any materials submitted by the entrants to the entrants after the end of the Promotion.
- The Promoter reserves the right to vary the terms of, or cancel, the Promotion at any time without liability to any entrant or other person, subject to applicable laws.
- The Promoter shall not be liable and excludes all liability (including but not limited to negligence, infringement of third party intellectual property rights and misleading or deceptive conduct) for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) for damage to property, personal injury or death suffered or sustained in connection with the Promotion or the use or taking of any prize except for any liability which cannot be excluded by law including as provided for under the Consumer Guarantees Act (NZ) and/or Australian Consumer Law (as applicable), in which case, that liability is limited to the minimum allowable by law in New Zealand and Australia (as applicable).
- Any disputes will be addressed by the Promoter or the Agency with the entrant. If the dispute cannot be resolved the Promoter’s decision will be final. The Promoter must act reasonably and in accordance with these Conditions.
- The Promotion is in no way sponsored, endorsed, administered by or associated with Meta (Facebook or Instagram) or any other social media platform and each entrant agrees to grant Meta a complete release from any liability or claims that they now have or may have in the future which relate to or are incidental to the Promotion. Entrants acknowledge and agree that:
1. any information they provide in connection with the Promotion is provided to the Promoter and not to Meta or any other social network; and
- any questions, comments or complaints regarding the Promotion will be directed to the Promoter, not to Meta or any other social network.
- The laws of Australia and New Zealand govern these terms and conditions and the conduct of the Promotion.
- The parties submit to the non‑exclusive jurisdiction of the courts of Australia and New Zealand.
